Uber Settles Background Check Sexual Assault Case Less Than 48 Hours After Jury Selection

Uber Stipulated the Assault Occurred; MDL Co-Leads Call on Company to Pursue Global Resolution for 5,000+ Survivors
AUSTIN, Texas, Oct. 2, 2026 /PRNewswire/ -- Uber Technologies, Inc. has settled Jane Doe QLF 001 v. Uber Technologies, Inc. less than 48 hours after a jury was selected in the U.S. District Court for the Western District of Texas. The case was to be the third federal bellwether trial in the In re: Uber Technologies Inc., Passenger Sexual Assault Litigation (MDL No. 3084). Opening statements had been scheduled for Monday morning before U.S. District Judge Charles R. Breyer, who presides over the MDL and personally oversaw the prior bellwether trials in Arizona and North Carolina.
The plaintiff alleged that serious failures in Uber's background check process allowed a dangerous driver onto its platform, and that those failures led to her sexual assault during a 2020 ride. The driver, Victor Huynh Le, was criminally convicted of sexual assault in 2022 and sentenced to 11 years in prison. During jury selection, Uber stipulated that it would not contest that the assault occurred. The terms of the settlement are confidential.

The driver in this case was convicted by a jury and sentenced to 11 years in prison. During jury selection, Uber finally conceded what it could no longer deny, by stipulating that it would not contest that the assault took place. That concession is long overdue, and we are glad to see Uber at last take a step toward accountability in this case, but there are approximately 5,000 others still awaiting justice.
Uber has begun to make changes to its safety practices because of this multi-district litigation and because survivors like Jane Doe refused to stay silent. Those changes come far too late for the thousands of passengers who have already been assaulted and irreparably harmed.
This resolution follows two consecutive federal bellwether verdicts in which juries in Arizona and North Carolina found Uber responsible for its drivers' assaults.
